HOA Fee Increase Limit in District of Columbia

Question:

I looked under your community resources but did not see the District of Columbia listed. Can you tell me is there a limit to the amount and HOA can raise fees in DC? Can you point me to where i can find the guidance of fee increases as well as any guidance on reserves? Many thanks.

Hi Cathy,

District of Columbia currently does not have statutes that apply specifically to HOAs. It does, however, have the following:

1. Condominium Act (Does not apply to HOAs) DC Code 42-19
2. Horizontal Property Act (Does not apply to HOAs) DC Code 42-20
3. Nonprofit Corporations Act DC Code 29-4

DC laws currently do not pose a limit on HOA fee increases. Additionally, there is no statutory requirement to conduct a reserve study and no statutory requirement to fund reserves.
