HOA Forcing Residents to Pay Dues Electronically

I live in a subdivision that has 3 different sections. One section is patio homes that is mainly comprised of people over 65 years of age. Recently the board changed management companies. After paying their HOA dues for the last 25 years by a mailed invoice, the new management company is expecting to collect the dues through an e-mail system connected to an app. Many of my fellow residents do not have a computer….some do but do not have a printer…..some have both but are not very good at doing things “on line”. The management company has been unresponsive. The board doesn’t seem to want to do anything to help. What can we do?

Hi Robert,

It is best to check your governing documents to see if they permit such a requirement (paying dues solely using electronic means). Bring this concern to the attention of your HOA board and management company. Exhaust all forms of communication. Attend the next board meeting and raise your concern there.

If you are dissatisfied with your current HOA board, consider removing ineffective board members. As per the North Carolina Planned Community Act § 47F-3-103(b), “Notwithstanding any provision of the declaration or bylaws to the contrary, the lot owners, by a majority vote of all persons present and entitled to vote at any meeting of the lot owners at which a quorum is present, may remove any member of the executive board with or without cause, other than a member appointed by the declarant.” A similar provision exists in the North Carolina Condominium Act. Refer to your bylaws for further guidance on board member removal.
