HOA Has Not Replaced Fence in Florida

Our HOA has not replaced our privacy fence that was destroyed by hurricane Ian. What recourse do I have? Fred

First, it is important to determine if this privacy fence is the responsibility of the HOA. If it is the homeowner’s responsibility, then the HOA does not have to replace it. If the HOA is responsible, there could be a few reasons why the HOA has yet to replace it. These include budget or reserve shortages, shifting priorities, and other ongoing issues.

What you should do is call attention to the fence. Let your HOA and board know that the fence has yet to be replaced. Perhaps they are just unaware. If the governing documents say that the fence is the HOA’s responsibility, point this out to the board. Communicating with your HOA is the best way to resolve this issue. However, if your HOA or board refuses to give you an answer, you may need to seek help from a lawyer.
