HOA Maintenance Activity Relocates a Tenant

I have a rental condo. I also have a professional property manager. On June 26th my tenants power started going off and on the next day she called my property manager and was told to check the breakers. the tenant also called the local utility SDG&E and an electrician which told her that the problem was the associations. My manager called the management company and was told that they were on vacation and to call back on 7-5-23 and there was nothing that they could do, then they refused to answer as by this time I the owner was involved and called every hour. finally 6*30-23 and a nleectrician showed up and put my section of the 5 meter scction on 1 phase leaving the unit WITHOUT ANY 220 V, NO AC, HOT WATER OR OVEN. The next day I put my tenants in a motel.

Hi Ben,

According to the Davis-Stirling Common Interest Development Act Section 4775(b), during the maintenance of areas under the HOA’s responsibility, the temporary relocation costs shall be shouldered by the unit owner. While maintenance is ongoing, you may coordinate with the HOA management company or the HOA board to fix the electrical issue.
