HOA Management Company Doesn’t Recognize the New Board

Our management company is denying a new board access and claiming the election wasn’t valid even though we filed it with the Secretary of State. We can’t make them give us access to our financials. We don’t know who is approving payments which is in our contract. We don’t know what to do.

Kindly verify whether your HOA followed the proper procedure in electing a new board. You may review the governing documents for this. If the election is valid, you may communicate with the management company and provide evidence of the validity. You may also check the contract to see what the company’s responsibilities are regarding financial access and payment approval. You may remind the management company of their duties during your correspondence. Make sure to keep proper documentation of all interactions.

Apart from these, you may also hold a special meeting to discuss the HOA management company and opt to remove or replace them. However, it may be best to consult a lawyer and make sure you’re not breaching the contract.
