HOA Management Company Enforces Rules Selectively

Question:

Can I sue my HOA management company for selectively enforcing our bi laws? our board president has been reported continuously for parking violations where she is completely blocking ingress /egress by parking 2 vehicles side by side in front of her garage door which is not allowed, and was even fined over $700 at one point for this same violation, yet continues to park this way and our management company responded to me that they give board members an exception when it comes to violations. I literally have this in writing from the owner of the management company. This is selective enforcement

For condominiums, you can file a complaint with the Office of the Condominium Ombudsman. Here is a copy of their comprehensive instructions for filing a complaint against condominium associations or managers. You may also call or e-mail your questions concerning your condominium to the Ombudsman at ombudsman@myfloridalicense.com. If that doesn’t work out or if you don’t live in a condo community, then you may want to seek further advice from a lawyer.
