Hello, the homeowners in our community are dissatisfied with the management company. The old mgmt company was bought by a larger company, but they are very disorganized. They do not deposit assessment payments for more than a month, then they send a late notice with fee. But it is them not crediting the homeowner account properly. I have been sending my payments through billpay, so I have bank records that prove I paid my dues. Still they say I’m 3 months behind on my payments. I sent them bank statements that show the money was debited from my account. I went to my bank and had a banker talk to supposedly the head of accounting at the management company, who insisted that I must provide copies of the cleared checks. However, the bank does not have copies of cleared checks, as they are processed as bill payments. I e-mailed the management company relentlessly, but they do not respond. Can I take legal action against the management company? I talked to other homeowners, who experienced the same thing. The other homeowners send checks, but they were told to do bill payments. This is unconscionable. We are planning on changing management companies, but how do we trust the accounts are correct if the management company’s records are not accurate?

Before proceeding with legal action, it may be best to first exhaust all forms of communication or available remedies to resolve the problem.
