HOA Management Company Refusing to Reissue Check for Overpaid Dues

Question:

I sold my condo in August and the HOA Management Company owes me $254 in overpaid dues. They claim to have sent a check on 09.29.23 that was never received. I asked them to stop payment and resend. They say they cannot do that, that they must wait until they receive the check back before they can send it again. Do I have any recourse? What if they never receive it back? I am still owed the money.

Hi Kelli,

You may issue a written request to the HOA management company to stop the payment and reissue a check to keep formal documentation of the request. If you do not hear back from the HOA management company, you may exhaust all forms of communication to contact them. You may also visit them in person if possible.

In addition, you may also contact the HOA board to raise the issue. Likewise, kindly exhaust all forms of communication. If possible, it may be a good idea to attend a board meeting and raise the issue. They may be able to coordinate more closely with the management company to help you get the payment back.

If all else fails, you may also file a complaint with the Washington State Office of the Attorney General. For further guidance, kindly consult a lawyer.
