HOA Manager Doesn’t Share Information in FL

Question:

My property manager won’t give me the information I requested and the HOA president is not following her responsibilities in maintaining any other members court yard’s except hers and other board members. What can I do to take care of this situation.

Answer:

Hi Dennis,

First of all, it is important to determine whether or not you have the right to access the information you requested. Not all records and information are available for the review of homeowners. Here is an article that may help you with this: https://www.hoamanagement.com/hoa-board-doesnt-share-information/

If you determine that you have a right to the information, then it is best to seek assistance from your HOA board. Let them know that your property manager is refusing to give you access to the requested information. This may be in violation of the Florida HOA Act.

As for your courtyard issue, check your governing documents to see if the HOA is responsible for courtyard maintenance. It is possible that courtyards don’t fall under the responsibility of your association but instead fall under the homeowner’s responsibility. If you determine that it is your HOA’s responsibility as per your governing documents, bring this to your board’s attention. Show them the specific provision/s that apply.
