HOA President Abuse of Power in Louisiana

Question:

Good day, I have some questions and concerns of the legal rights of the HOA president here at Bayou Shadows of slidell La.
Many issues for years with him taking out his roll. Upon many issues I do know how resolve them. Not knowing what is my legal right within the HOA and if they are misusing power for personal gain. Including bullying owners and residents to move if not liked. Please help. I need all the information I can get. So, I know what I can do to protect myself and property including vehicles.

Answer:

Hi April,

If your HOA president is abusing their power or using it for personal gain, the best thing to do is to remove them from their position. If your HOA is organized as a corporation, Section 1-808 of the Business Corporation Act provides guidance on how you can do that. However, you should also check your governing documents for the requirements and procedures for removing a director.

If your HOA president has committed financial crimes such as fraud or embezzlement, make sure to report them to the authorities.
