HOA President Nominating Candidates for Election

Question:

Can an existing board choose who to nominate for upcoming election? Our president who is no longer eligible to run for office is handpicking four candidates to run for open spots and putting up billboards for them including on his own yard and in our front entrances

Answer:

Hi Denise,

Nominations can be done by any member of an HOA. Board members can nominate other owners, but that does not necessarily guarantee their win. Other homeowners are free to run for positions on the HOA board in addition to the four nominated by the president. As for campaigning rules, you should refer to your association’s governing documents to understand what’s allowed and what’s not allowed in terms of putting up signs and billboards.
