HOA Prohibiting Gathering in Common Area

Question:

Can my HOA stop any group within the community from gathering in any of the amenities or common ground – such as an assigned Park.? A group did that in my community and “Compliance people” interfered demanding to know what we are talking about. Plus we recorded the interference to show others and they are demanding we NOT do it. What are our rights???

Hi Nancy,

An HOA generally can enforce rules for common areas, such as establishing operating hours and prohibiting events without permission. That being said, an HOA can’t arbitrarily claim you have violated a rule based on no merit. It is best to ask the HOA what specific rule you broke to ensure that you are not being targeted unfairly. You are also entitled to a certain level of privacy.
