HOA Retaliates After Resident Refuses to Give Free Utilities

I own one house in a small group of 15 houses. The HOA Board and management company insists upon stealing water and electricity from my house. Apparently the prior owners allowed this, I am guessing because they both worked full time and were unaware of the repetitive thefts. I will not allow it and have put locks on my utilities. In exchange, the Board and management company deny services to me that they provide to all others. They are into me now for at least $5,000 of personal expense on community property that is right outside my front patio. Also, the HOA controls irrigation on property I own. They have put my house on a separate control so they can turn irrigation off all around my house. They make me pay $1,000 for every time I need tree trimming for very large oak trees.

Homeowners associations must maintain common areas and provide the services homeowners need as required by the governing documents and state law. You may raise this with the HOA board. If they refuse to cooperate, this may be considered retaliation by the HOA. You may contact the Texas Attorney General and file a complaint. It may also be wise to consult a lawyer for further guidance.
