Question:
We have a POA member who is trying to make a ruling on a public street that is outside of our neighborhood. We live in a gated community and the issue in question is that our local elementary school walks our kids out to a public street for pick up. This particular board member does not like the traffic back up this causes for about 5 minutes a day and has contacted the elementary school telling them they must cease letting kids be released to this side of the school.
Can a POA dictate what a public elementary school does on a public street?
If you can direct me to any legal documentation, I would greatly appreciate it.

If the street is public and not owned by the HOA or located within the gated community, then it is likely that the HOA does not have jurisdiction over it. This means the HOA can’t dictate rules and restrictions concerning the street. That said, it is best to check with the local government to see what can be done.
