HOA Selectively Enforcing Rules Regarding Traffic

Question:

I have a minor issue with my home owners association. Through out the year on occasion I sell items on Facebook Market place. That means people come to my home and pick up and pay for items on occasion. My street is a cul-de-sac. In my neighborhood it is the first street to the right so when people come into the neighborhood & not sure where they are they always come down my street to turn around. Also there are Amazon, UPS and many other food deliveries to all the other neighbors. Even some of the other neighbors sell on Facebook like I do and have many people come to their home to pick up items. I just received a notice from the HOA about having to many people come to my house. They are blaming me for all the traffic that comes down my street. It is not just me that is causing this issue. They are telling me that I am in violation because I put things out side my garage for people to pick up. Obviously this is not fair in any way shape or form. They would have to shut down every one in my neighborhood. What if anything can I do about this as it is not fair to me that I can not do it but everyone else can. They have to prove it witch would be impossible. I also have cameras on my house that film 24 hours. Can I do anything at all. It is just not fair for me because every one else does the same thing. What rights do I have. How can I stop them from harassing me about this when it is not my fault but every one else does the same thing?

Thank You

– Stacey

Answer:

Hi Stacey,

Kindly review the governing documents to verify whether or not you’re in violation of the rule they claim. You can also verify whether or not your neighbors have received similar violations. If you believe you’re on the receiving end of selective enforcement, you may write a letter to the HOA board stating your case.

You may also raise your concerns at a board meeting or request a hearing to tell them your side of the story regarding deliveries and other residents selling on Facebook Marketplace. It would be best to have documentation and evidence to back up your case. For further guidance, kindly consult a lawyer.
