HOA Sent Bills to Old Address

Question:

How can an hoa fine me triple what I owed when they never sent me any bills? I moved in July of 2022 the management company randomly sent all bills to a home we owned in another community 7 years ago. We have no idea why. We thought the hoa fee was escrowed as it was where we had our last two homes. We got a notice from their attorney in November and they have added 1540 to the fines.

Answer:

Hi Lisa,

Kindly check the governing documents to find provisions regarding assessment bill delivery and notices. Usually, HOAs send these through the mailing address given by the homeowners. This address may be in the membership list, which you can also request to view from the HOA board. The address of your old home may be the one listed there, which could have been the cause of confusion. You may also speak with the HOA board to ask why they sent it to your old address. For further guidance, kindly consult a lawyer.
