HOA Soil Study Inspection in California

The HOA commissioned a soils study regarding repair of our common streets. Can the HOA deny a homeowner access to the soils study?

Answer:

Hi Rudolph,

According to the Davis-Stirling Common Interest Development Act Section 5205(a), the association should make association records available for inspection. However, there are some exceptions outlined in Section 5215 including those involving sensitive information like litigation, individual privacy, collection activity, disciplinary actions, and others. If the HOA denies the request, you may ask the association why they are doing so. According to the same section, the association must provide a written explanation specifying the legal basis for withholding the record.
