HOA Won’t Get Involved in Neighbor Dispute

Question:

Yes, I have a question on HOA’s involvement with Neighbor constantly complaining about things at my house when there’s no violations that are covering, they do not approach me at all and go straight to the HOA hiding behind them. What is responsibility to mediate the situation and what other steps do you think I should be taking to cover myself? I’ve been documenting everything, and I have a meeting with the president next week. The HOA doesn’t seem to want to do anything as they are saying get an attorney or the police involved if the police get called that’s only considered to be civil matter (I’m a retired cop) and basically won’t do anything am I correct along these lines? I could file a report for harassment because this is going on way too long. Am I allowed to ask the HOA for all the numbers of times I’ve had complaints logged against me even though that there was no violations, it just seems like this is harassment by my next-door neighbor that hides behind the HOA. Hi Michael,

It is best to attempt to resolve the situation with your neighbor first. The HOA may not have an obligation to intervene when it comes to neighbor disputes unless rules are already being broken. The HOA may not be doing anything about it because the neighbor’s complaints are baseless. It is a good idea to document everything to the extent that you can.

Try to resolve the dispute with your neighbor by talking to them or setting up a mediation. The HOA may not be required to provide you with a copy of internal complaints records, though, unless you take legal action.
