HOA Won’t Perform Much-Needed Repairs

Answer:

Hi Richard,

If your HOA has consistently ignored your requests for much-needed repairs, you may need to take formal steps to compel them to fulfill their obligations. Start by reviewing your HOA’s governing documents, including the CC&Rs (Covenants, Conditions, and Restrictions), bylaws, and maintenance responsibilities outlined in the documents. These documents typically specify what the HOA is responsible for maintaining and repairing. If the repairs fall within their obligations, gather evidence of the issues, such as photos, written complaints, and any correspondence with the HOA. Documenting their lack of response or inaction is crucial.

Next, send a formal written demand to the HOA board or property management company detailing the necessary repairs, referencing the governing documents, and giving them a reasonable deadline to respond. If this approach doesn’t yield results, consider involving a mediator or arbitrator. Taking legal action should be your last course of action, as it can be very time-consuming and expensive.
