Homeowners Claiming the Clubhouse Policy Changes Required a Vote

Question:

I am on the board and hold position as President since the first of this year, we have a few particular Homeowners who feel that a Club House Policy that had changes made to it to protect the residents by the Board earlier this year should have been voted on. However, in having an attorney along with another board member who has resided in this community for many many years said it wasn’t required. Only changes to the CC&R’s require a vote related to changes.
These few homeowners have called an emergency HOA meeting for this Friday and I personally would like to have more information on this prior to the meeting. Is there someone I can speak with or have review this section of our CC&R’s to validate or provide information for this upcoming meeting? I hope to prevent this meeting from being ugly and out of control. I would welcome any assistance or information, Thank you. Alexi

Answer:

Hi Alexi,

You may review the governing documents with an attorney experienced with HOAs to verify whether or not the clubhouse policy changes need a vote. You may also request the attendance of said legal counsel during the meeting if allowable.
