Homeowners Want to Replace HOA Management Company

Question:

We are not satisfied with our Management company. We don’t have a HOA that we can go to. No phone numbers or emails. I have tried to leave messages and the President has not responded. I asked the manager to give her my phone number or email. Nothing! Many of the neighbors are dissatisfied. Can we start a petition so that when their contract is up in April they’re down. Our community has gone down hill because of them. Council does not support the community.
Also, I contacted a lawyer concerning two incidents that happen in my condo and they charged me each time. It is a conflict of interest because paying my fees also pay for legal fees. I have a copy of our budget

Hi Marteenia,

The HOA board generally has the power to replace the management company. That said, you can approach the board with your petition to let them know about your dissatisfaction. However, the board is not required to make the change. If you are dissatisfied with your HOA board, you might consider removing board members. As per the Pennsylvania Statutes Section 5303(f), “Notwithstanding any provision of the declaration or bylaws to the contrary, the unit owners, by a two-thirds vote of all persons present and entitled to vote at any meeting of the unit owners at which a quorum is present, may remove any member of the executive board with or without cause, other than a member appointed by the declarant.”
