How Can an HOA Collect from Nonpaying Owners in Georgia?

Question:

What can we do if only 32 people are paying dues and the other 67 owners don’t pay their water or assessments? This community is suffering terribly to the point the water will be disconnected.

Answer:

Hi Enjoli,

Homeowners are usually required to pay their dues and assessments to the HOA. Failure to pay those dues on time or at all can result in a number of consequences. Depending on your HOA’s governing documents, your association may be able to charge late fees and interest, refer delinquent accounts to a collection agency or lawyer, place a lien on the property of the non-paying owner, and even initiate foreclosure. Check your CC&Rs what enforcement and collection actions are available to you.
