House Bill 320 now allows homeowners associations to conduct annual meetings by means of remote communication unless otherwise restricted by their governing documents. Associations must provide members with a choice to “opt-in” to communicate using electronic means and let them know how they can do so. Essentially, members must agree to this by providing the association with their email addresses. Boards must verify that each participating person is a member of the association and provide remote members with a reasonable chance to participate and vote. The bill also now allows electronic voting.
