How Often Does an HOA Need to Update CC&Rs?

Question:

How often does an HOA need to update the CCNR’s , bylaws etc. to be current with state laws. Many HOA’s do not have the financial resorces to update every three years. Also, if they did update the HOA documents, the BOD might be unable to get a membership majority to make the change due to membership apathy. What do you do?

Hi Paul,

California law currently does not require HOAs to update their CC&Rs and bylaws within a set timeframe. That being said, it is a good idea to review your governing documents for any outdated provisions every 3-5 years. Have the foresight to set aside a portion of the budget for this task, which usually requires the help of a lawyer.
