How to Get an HOA Board Member to Resign in GA

Question:

Recently we learned that 2 of our condo HOA board members have discussed personal financial information on an owner who is past due. This was done at the annual meeting-pointing her out,telling 40 people at meeting about her past due etc. The other board member has discussed these details and how cheaply she would be able to buy that condo ( she owns 3.) We would like to file a complaint to see if we can get them to resign as these aren’t the only problems. Who do we file with? Thanks

Hi Venice,

There is no separate body that oversees homeowners associations in Georgia. That being said, if you wish to remove a board member, you may do so according to Section 14-3-808 of the Georgia Nonprofit Corporation Code (if your condo is organized as a nonprofit). Your bylaws may also indicate the requirements and procedures for the removal of a board member.
