How to Remove HOA Board Member in Indiana

Question:

Am I able to remove myself from the POA. The POA has never had an election. Receipts or budgets are never given to members.
We have a vigilante board of managers who refuse to abide by by-laws (even after requests by board Attorney).
I have been retaliated against and I am very uncomfortable attending meetings.

What are my options?

Answer:

Hi Faith,

Membership in HOAs is typically mandatory, with no way to cancel that membership apart from selling your home. That being said, if your HOA board is not doing its job properly, you might consider removing them. The Indiana Nonprofit Corporation Act provides guidance on how to remove board members. Similarly, your bylaws should contain procedures and requirements for removing a board member. Beyond that, you may want to seek further assistance from a lawyer.
