Ice Dam Caused Water Damage in Condo Unit

Question:

I live on the top floor of the building. During the winter there is ice and snow build up that creates ice dams and I have had water coming into my unit through the windows. Is it the associations responsibility for the damages to the structure/wood rot to the window frames because of their lack of maintenance and timely removal of the ice and snow from the roof?

Answer:

Hi Shannon,

Maintenance responsibilities are usually laid out in the governing documents of the HOA. As such, it is important to look there first to determine who is responsible. Since every association is different, you might also want to check with your HOA board or manager to see if the association’s insurance will cover the damage.
