Incapacitated HOA President Represented by Spouse in Florida

Question:

Our HOA President is currently in the hospital and we are still receiving emails from him.
The issue here is they do not read like he wrote them?
Can a spouse send and reply to emails directed to the HOA Board when they are not on the board and still sign the presidents name?

– Chuck

Answer:

Hi Chuck,

You may contact the president through other means of communication or visit him physically to clarify the situation. You may also review the governing documents to see whether there are provisions for such cases.

Apart from this, according to the Florida Homeowners’ Association Act Section 720.316(1)(c), during emergencies, the board of directors may appoint assistant officers who are not directors provided that the governing documents do not prohibit it. Kindly verify if this applies to your situation.
