Investor-Owned Fence in HOA Needs Repairs

Question:

HOA refuse to help! HOA was contacted regarding back property with a fence down. The fence belong to investors who owns the property for more than 5 years now.

I contacted the HOA regarding the down fence that belong to them, and I am told that: It is between me and the neighbor. and the HOA refused to help. I asked the HOA if they would at least send a letter and they said no.

Problem is no one lives in the house in more than 5 years and I have no way to get in touch with the investors who own the property.

Why wont the HOA help me! When I had a down fence they not only contacted me and sent letters but also sent a letter to my attorney.

What must I do? Should my HOA provide some help to me? Thank you.

Hi Edena,

If the HOA does not own the fence or the governing documents say that the fence is not under the HOA’s responsibility, then your HOA does not have to repair it. That means the homeowner has to repair it. The HOA is simply responsible for enforcing the rules, which can include notifying and fining you for a fence that isn’t up to the standards of the association. Perhaps you can ask your HOA for the contact information of the investor so you can get in touch with them.
