Is the HOA Responsible for Damage by Vendors?

I have a home in South Florida, I spend two weeks a month there other times I spend it at my home in NJ. My house I Florida has a carport, when I leave I put a car cover on my car for protection, on occasion the lawn service cuts through my carport only when I’m not there I brought it to the attention of the HOA president and he said the dispute is between me and the lawn service company, I expressed concerns of damage being done to my vehicle due to the equipment that’s carried, I told him the HOA is directly responsible for the actions of contracted services. What recourse do I have?

Hi Roy,

The first thing you should do is inform the HOA board about the damage, even if you already did it once. Your HOA should have the vendor remedy the problem. If the vendor does not fix the issue, your HOA can have the damage repaired and collect the cost of repairs from the vendor. If the problem persists even after your repeated requests, you can make the repair and have the HOA reimburse you.

Make sure to document everything — from your communications to the damages to the related expenses. This will come in handy in the event that you enter dispute resolution or head to court. Consult a lawyer for further guidance.
