Late Fees on Unpaid Dues as a Result of Bank Error

Question:

I’ve been late in my association, I recently received a letter for pre-lien, as I received this I viewed my account with them and noticed extra missing payments that they did not take from my bank account as my bank sends them a check. Now I got a refund from bank stating that the checks were over 90 days without being cashed em I still responsible for all those late fees and lien fees?

Hi Julio,

It looks like there has been a misunderstanding between you, the bank, and your HOA. The checks may have gotten lost in the mail. I suggest you talk to your HOA board or manager about the issue to clarify things. You can also ask them to lift the late fees and lien fees since the late payments (or nonpayment) were a result of an error.
