Maintenance of AC Copper Lines

Is HOA responsible to repair and pay cost for AC copper line that is embedded in structure in accordance to Florida State Statute 718.108?

Hi Joshua,

It depends. According to the Florida State Statutes Section 718.108, the copper line may be a common element if it is:

1. Part of the easements or installations through units that furnish utility services to the common elements or units
2. An easement of support that contributes to the building’s support
3. Expressly designated as such in the governing documents

But, if the copper line is part of a limited common element, then it will depend on what’s outlined in the governing documents. Either the HOA or homeowners will be responsible for maintenance, as provided for under Section 718.113.
