Question:
I manage a HOA in Colorado. What is the state law on infrastructure.
I have a sewer lateral that goes from the out side of the condo to the main sewer line that is need of replacement. Who is responsible for the repair. The HOA or the unit owners who share the lateral coming our to the building to the main sewer?
I personal thought as it is in a general common ground infrastructure was the responsibility of the HOA but I have board member that says it is the owners responsibility. Can you clarify who is responsibly?

Unfortunately, the Colorado Condominium Ownership Act does not address this matter. It is best to check the association’s governing documents, including the community plat. These documents should identify which components are considered general common elements and limited common elements. You will be able to determine maintenance responsibilities from there.
