Management Company Won’t Turn Over HOA Documents

Question:

We are part of a transition committee and the HOA management company refuses to hand over documents and now have ceased to communicate with the transition committee. Can you please advise.

Answer:

Hi Daniel,

The management company is legally obligated to cooperate by providing necessary documents and assisting during the transition. If the management company is refusing to hand over documents and has ceased communication with the transition committee, it is important to take action.

Start by formally requesting the documents in writing, specifying the items you need, such as financial statements, contracts, reserve studies, insurance policies, and meeting minutes. Make sure to send the request via certified mail to create a record of the communication. Additionally, you should check your management contract to see the obligations of the management company when it comes to document turnover.

You should also review the HOA’s governing documents to ensure you understand the legal requirements and timelines for document transfer during the transition. If the management company continues to withhold documents or stop communicating, consider consulting a legal professional.
