Minnesota HOA Not Maintaining Common Areas

Question:

If the Association is not keeping the common areas clean and attractive, how should I, as a homeowner, address the issue?
I have already informally expressed my concerns, but didn’t receive and response from the management company (Cities Management). Shall I submit a “official” complaint? Do you have a template?

Answer:

Hi Claudia,

According to the Minnesota Common Interest Ownership Act Section 515B.3-107(a), the association is responsible for maintaining common areas unless otherwise specified in the governing documents. Kindly check your governing documents to verify if the HOA is not responsible for maintaining common areas.

If the HOA is responsible, you may raise your concerns with the HOA board and property management company, referencing the governing documents and state law. Unfortunately, we do not have a template for homeowner complaints made against the management company or board.
