Missouri Amending Bylaws to Limit Rentals

Question:

Our HOA requires two thirds of owners to approve amendments to our by-laws. We have a proposed amendment to limit the number of homes offered for rental to 15%. We want to maintain a quality neighborhood and the homes that are not being maintained are almost exclusively rentals. Is there a problem amending the by-laws for this?

Answer:

Hi Larry,

There should be no problem amending your bylaws, provided the amendment meets the required percentage of votes from the membership. Missouri currently does not have any laws that prohibit an HOA from placing reasonable restrictions on rentals.
