Missouri Condo With No Board Members

Question:

I belong to a board on a condominium association in St. Louis Missouri. I would like to know what will happen if all board members step down and nobody steps up to take their place. We are having this issue in our condominium association and I would like to know where to get information regarding who takes over the condominium association and how it is managed.
I would like to have an article on this information so I can send it out to all of my homeowners so they will know what is going to happen when the board steps down.
Thank you for your time

Answer:

Hi Terry,

The first thing you must do is check your governing documents. Your bylaws and CC&Rs may contain information on what you can do when there is a vacancy. You may be able to appoint board members as well. If no one is willing to take over the position, a court may appoint a receiver. Here is an article you may find helpful: https://clarksimsonmiller.com/hoa-board-mass-resignation/

Beyond that, you may want to consult a lawyer for further guidance.
