Modifications Need Signature of Attached Owner

Question:

Note – the declarations for the HOA state that a modification to a duplex property needs written consent from the attached owner.
There is nothing stating a replacement or repair needs a signature. Our HOA is saying it is the opinion of the association lawyer that a signature is required. Our attached duplex owner does not want to get his half of the roof replaced and will not sign off for us to get ours replaced.
