Multiple Complaints for an Ohio HOA

Our HOA has been charging us a late fee when we have set up auto pay several times. They just cut down a perfectly healthy tree down that was giving us privacy in our front window. They have charged the community 10 million dollars to put on a new roof on all the units and we did not need one. They charge us for snow removal and they do not remove snow and hardly lay down salt. I would love to know what I can do about this because they won’t even come and fix our stairs when we’ve asked.

Hi Anthony,

First of all, make sure your auto payments have been going through on time. Talk to your HOA board about the late fee if you think it is an unwarranted charge.

Secondly, if the tree is on HOA ground (as in, located in a common area owned by the HOA), then the association has every right to remove it without seeking permission. They might have had a reason to cut it down.

Thirdly, you can approach your board about the new roof. Even a roof that looks fine may have several flaws or damages already. Your HOA might have replaced it according to its reserve study.

Talk to your board about the snow removal as well. If it is included in the annual budget, then the money should go to that expense.

Finally, if these stairs are common elements that the HOA is responsible for, then the HOA must certainly repair them if necessary. Talk to your HOA board or manager about the problem. You might need to file a complaint or work order depending on your community’s process.

If you are unsatisfied with the way your association is being run, you might consider running for a position on the board at the next election. Remember to bring these matters to your board’s attention as well.
