Neighbor Dispute Over Dog Barks Causing Pain to Patient

What is considered excessive barking by a dog in an independent shareholders retirement community that is pet-friendly? We have a resident with stiff body disease that says one bark brings her pain and wants the neighbor’s dog removed. The dog might bark twice when she leaves her apartment and the door shuts. Do we need to make accommodations for her?

Excessive barking may be up to interpretation. You may review how the community rules are worded to determine the right interpretation. It may also be wise to resolve this dispute internally by allowing these neighbors to talk and reach an agreement. The dog owner may also consider professional dog training to address the barking issue.

However, consider whether there are reasonable accommodations to be made for the sick resident through noise-dampening measures. You may also negotiate with the dog owner and coordinate when they can walk their dog. It may be wise to provide these reasonable accommodations as not doing so may violate the ADA or the Maine Human Rights Act. For further guidance, kindly consult a lawyer.
