No Fence Policy in Michigan

Question:

So in our HOA we have a no fence policy front or back my property is right next to the trail head where people walk their dogs without leash my dogs are in my back yard only teathered to a long leash so dogs can come into our yard and cause harm to our family and also have a 4ft deep 20-25 pond that people could walk into . So we put up a fence and are in trouble with the HOA

Answer:

Hi Dave,

There are no specific laws in Michigan that protects a homeowner’s right to a fence. We recommend consulting your governing documents to see if there are clauses that protect a homeowner’s right to fences. Otherwise, the no fence policy is effective and you may need to take down the fence as requested by your HOA.
