Nobody on Condo Board in Nebraska

Is it True in the State of Nebraska, that if you live in a condominium that you have to have a board? And if so, what happens if no one wants to be on the board?

Hi Laura,

If the condominium has established a condominium association, then the association has to have a board of directors. The bylaws should indicate how many board members are required. In addition, if the association is a non-profit, the Nebraska Nonprofit Corporation Act Section 21-1968(a) states that each corporation must have a board of directors. Without one, the corporation may not be allowed to exist, which may take away the community’s corporate veil.

That said, having a board of directors may be mandatory for condominium associations. If nobody wants to run for the board, usually the current board members remain in office. If there is no board, the community may need outside help. The governing documents may allow the unit owners to go to court to have someone appointed to the board or appoint a receiver.
