Old HOA Board Didn’t Enforce Rules

Hello: I am on the board of directors for my HOA condo building (175 units).. I filed a noise complaint in May 2022 when I was not on the board. Now I am on the board but my noise complaint has gone un resolved by the Chair of our Rules Committee. It seems and feels awkward at times and now my fellow board members are being asked to render a decision to possibly fine the offenders who have stated “go ahead fine us, a fine will not change our actions”… The board’s lack of resolving the problem since May 2022 has added much “heat” to the situation. Seems only now that I am on the board, does the board seem half way interested in paying attention to the noise problem, which is unfair to me, our board, our owners, and the offenders. what are your thoughts? thank you.

It seems that the HOA board in charge back in May 2022 when you filed your noise complaint did not follow proper procedure or take enforcement action. Now that you are a board member, it is best to follow the procedures outlined within your CC&Rs when it comes to enforcing noise rules. You may not be able to reverse the previous board’s actions, but you can make things right by starting to enforce the rules the proper way.
