Opting Out of a New HOA in Texas

Question:

I purchased my home in 2019. I specifically asked my builder if this community had an HOA. At closing, I verified with the title company that there was not an HOA. She stated that we did not have an HOA. One was established in 2022. They have imposed fines. They have rules that are just crazy. Since the HOA was NOT established at time of purchase, am I exempt from participating? Is joining voluntary since it was not formed at time of purchase?

If your neighbors are forming a new HOA, you can likely opt out of joining it. This means you won’t be a member of the HOA and cannot enjoy the benefits/amenities that come with it. Additionally, you are not subject to the HOA’s rules or the mandatory fees.
