Question:
I own a condominium in a Kansas community that also contains Townhomes. Those residents have their own HOA and management company. The condo owners have a separate HOA and management company but also must pay HOA dues to the Townhomes’ HOA. I feel this is unfair but I am asking you is this legal?

Answer:
Hi Beverly,
There is currently no law in Kansas that addresses your specific situation. That being said, you may want to check your bylaws and CC&Rs. These documents should shed some light on how dues are determined in your HOA. You may also want to consult a lawyer for further advice.
