Our CCR and State statues state the Assesment fee are based on sq ft of units. This fee covers maintenance and general common area expenses. Can the HOA charge a separate maintenance fee on pets?
Our CCR has a pet regulation where it states “all animals must register and be approved by BOD”. A new Rule and regulaion created by the board state only dogs have to register. The board president has 7 cats. Does the rules and regulation supercedes the CCR?

Kindly refer to the governing documents to see whether the association is allowed to impose additional maintenance fees on pets. You may also consult a lawyer for further guidance. Apart from this, the CC&Rs take precedence over the HOA’s rules and regulations. If the rule contradicts what’s stated in the CC&R, kindly bring this up with the HOA board.
