Previous Owner Responsible for Repairs in HOA

Question:

Moved into a townhouse one (1) month ago and as of yesterday received a violation notice from HOA officer. It appears there’s chipping paint on the deck and they gave twenty (20) days to rectify it. However, it was there prior to purchasing home, so why wasn’t previous owner responsible?

Hi Patricia,

While the chipping paint might have existed prior to buying the home, the HOA has no way of enforcing the rule against the previous homeowner. You, as the current homeowner, are now responsible for it. You may want to consider contacting the seller/previous owner of the home and negotiating with them to pay for the repainting. However, there is no guarantee that they will agree to this arrangement.
