Problem Board Members in Hawaii HOA

At present, the hoa on our property is using funds for vanity projects instead of things like broken sewer lines. They also slandered a resident by saying that he tampered with a pressure valve and would not back down, even after maintenance and the plumber said it wasn’t tampered with. They now want to fire our property management company and it appears that, possibly, the president of the hoa stepped down to have the management company that he works for be the new management company, therefore, giving them a monopoly on the decisions they make with no oversight. Also, they just added an insurance agent to the board, who is now getting insurance quotes for the master and flood policies. I believe that these items are conflicts of interest. Is there anything we can do?

Hi Crystal,

You might consider removing the board members who are causing problems in your community. The Hawaii Nonprofit Corporations Act Section 414D-138, which applies to HOAs organized as nonprofits, provides the requirements and procedures for removing a director who was elected by members or directors. Your own association’s bylaws may also contain the requirements and procedures for this.
