Problem Looking for and Understanding Virginia Laws

Question:

I am a currently a home owner and a board member of the Madison Chase Condominium Association. As a member of the Madison Chase Association in Virginia:; how can I obtain a hard copy of the Virginia Common Interest Community Management Information Fund Regulation.
Quite frankly, my Condominium Association Board, is being challenged ( if not dictated ) by our Property Management Company in terms of how often the
Association Board can meet officially and unofficially within a calendar year.

Secondly, we are also being told via the current Property Management Company that, we as an Association Board, has no authority to supersede / dispute, or cancel any of the contracts elicited by the Property Management Co ( (regardless of the less than satisfactory work done by the contractors ). Therefore I am appealing to you, as to how I can obtain a hard copy of the Virginia Common Interest Community Management Information Fund Regulations.

P.S. We as an Association Board of Madison Chase Condoniums , is really struggling to understand Virginia’s governing laws / regulations when it comes to the rights of our residents as well as Virginia’s laws regarding HOA’s. If you can direct me, as to where or how I can obtain a hard copy of Virginia’s HOA’s rules/regulations, it would be greatly appreciated.

Answer:

Hi Kenneth,

You can find the Virginia Common Interest Community Management Information Fund by clicking here. Additionally, you can find information on how often you can hold board meetings within your governing documents (particularly the bylaws). As for the vendor contracts, it is important to review the contracts for any termination or cancellation clauses. While the management company may coordinate with vendors, whether or not to cancel a contract is ultimately the board’s decision.

If you are having trouble understanding your governing documents as well as the Virginia laws that apply to condos, it is best to hire a lawyer.
