Problem With HOA Board in California

Question:

We are in desperate need of legal counsel. I’ve provided a list of concerns below:

.1 I’ve been living here for almost 2 years and no HOA meeting.
2. Mismanagement of funds.
3. No major work has been done on the property and then they increased the hoa out of nowhere.
4. Improperly adding $12K termite bill that there forcing the owners to pay out of pocket including paying expense.

A lot of the owners are skeptical of where all of the money has gone. We’ve come to find out that theres significant damage to the buidling (roof / plumbing / termites) due to the neglect of taking care of the building

We would like to change HOA company to another one and remove some of the board due to the neglect as well.

When some help soon because there have been major decisions with expenses being forced upon us because their lack of transparency..

Answer:

Hi Todd,

You may remove board members by adhering to the provisions of the Davis-Stirling Act as well as the provisions of the association’s bylaws. If you suspect that fraud has taken place, report your concerns to local authorities. You also have the ability to take legal action, though this will require the help of an attorney.
